These Terms of Service ("Terms") govern your use of the HangarScope application and related services (together, the "Service"), provided by HangarScope ("we," "us"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
HangarScope helps aircraft owners track their aircraft by storing and analyzing data you provide — including engine monitor logs, flight track files, oil analysis reports, and maintenance documents — and by presenting that data back to you as flight summaries, trends, and reports. The Service is a record-keeping and analysis tool. It is not a substitute for FAA-required maintenance records, airworthiness determinations, or the judgement of a licensed A&P / IA.
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You must be at least 16 years old to use the Service. You agree to provide accurate information and to keep it current.
You agree not to:
You retain ownership of the files you upload and of the aircraft data you provide ("Your Content"). You grant HangarScope a limited, worldwide, non-exclusive license to store, process, transform (for example, to extract flight rows from an engine log), back up, and display Your Content to you, solely for the purpose of operating and improving the Service for you. We do not sell Your Content and we do not share it with third parties for their marketing. We use service providers (for example, our cloud host) to operate the Service; those providers handle Your Content on our behalf under their standard data-processing terms. You are solely responsible for Your Content, including whether you have the right to upload it and whether its retention or processing complies with any applicable regulations that apply to you (such as operator-specific record-keeping rules).
Some features require a paid subscription. Pricing and included limits for each tier are shown on the pricing page at the time you subscribe. Subscriptions renew automatically until canceled. You can cancel at any time; cancellation takes effect at the end of the current billing period, and no refunds are issued for partial periods unless required by law. Taxes may apply in addition to the listed price.
We may suspend or terminate your access to the Service if you materially breach these Terms, if your use creates risk or legal exposure for us or for other users, or if we are required to do so by law. We will use reasonable efforts to notify you before doing so, except where doing so would be unsafe or legally prohibited. You may delete your account at any time from the account page. Deletion permanently removes your account, your uploaded files, and derived data; it is irreversible.
The Service is provided on an "as-is" and "as-available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that any analysis, finding, or derived value it presents will be accurate or suitable for any particular purpose. To the maximum extent permitted by law, HangarScope disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, HangarScope will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars.
You agree to indemnify and hold HangarScope harmless from any third-party claim, damage, or expense (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your breach of these Terms.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. You and HangarScope each agree to submit to the exclusive jurisdiction of the state and federal courts located in New York for any dispute arising out of or related to these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction.
If we make material changes to these Terms, we will update the effective date above and notify you by email before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
